Terms of Service & End-User License Agreement

Welcome to Nana Pinyin Tutor ("App"). By downloading, accessing, or using our App, you agree to be bound by these Terms of Service and End-User License Agreement ("Terms"). If you do not agree, please do not use the App.

1. Acknowledgement

You and Nana Pinyin Tutor ("Developer", "we", "us") acknowledge that these Terms are concluded between you and the Developer only, and not with Apple Inc. ("Apple") . The Developer, not Apple , is solely responsible for the App and the content thereof.

2. Scope of License

We grant you a non-transferable, non-exclusive license to use the App on any Apple-branded or Android products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions . This App may be accessed and used by other accounts associated with the purchaser via features like Family Sharing or volume purchasing.

3. No Account Required

You can use the App without creating an account. Your progress and settings are saved locally on your device. If you uninstall the App or change devices, your local learning progress may be lost.

4. Subscriptions and Purchases

The App offers optional in-app purchases and auto-renewing subscriptions to unlock Premium features (e.g., Ad-Free experience, unlimited voice evaluations).

4-1. License Types

This App offers two types of purchases:

4-2. Terms for Auto-Renewable Subscriptions

  1. Payment will be charged to your app store account at confirmation.
  2. Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
  3. Account will be charged for renewal within 24-hours prior to the end of the current period.
  4. You can manage and cancel subscriptions in your device settings.
  5. No cancellation of the current subscription is allowed during the active subscription period.

4-3. Terms for One-Time Purchase (Lifetime)

  1. Payment is a one-time upfront fee granting you permanent access to the App's premium features.
  2. Includes Updates: Your purchase includes all regular app updates, bug fixes, and feature improvements delivered through the App Store.
  3. Definition of "Lifetime": "Lifetime" refers to the lifespan of this specific App. You will have access to the premium features for as long as we continue to support and maintain the App. It does not guarantee access to entirely new standalone apps or fundamentally different future services.
  4. Refunds are subject to the platform's refund policy.

4-4. Restoring Purchases

If you reinstall the App or switch to a new device (using the same store account), you can restore your Premium access using the "Restore Purchases" button in the Settings menu.

5. Ad-Supported Free Version

If you do not purchase a Premium subscription, you may access certain features by watching rewarded video advertisements. Ad availability is subject to third-party ad networks (AdMob) and is not guaranteed.

6. Maintenance and Support

The Developer is solely responsible for providing any maintenance and support services with respect to the App. You and the Developer acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

7. Warranty and Disclaimer

The App, including the AI Voice Scoring feature, is provided on an "AS IS" basis. While we strive for accuracy, we do not guarantee that the pronunciation feedback will be 100% error-free.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

8. Product Claims

You and the Developer acknowledge that the Developer, not Apple, is responsible for addressing any claims of the end-user or any third party relating to the App or the end-user’s possession and/or use of that App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

9. Intellectual Property Rights

All content within the App is the exclusive property of Nana Pinyin Tutor. In the event of any third-party claim that the App or your possession and use of that App infringes that third party’s intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

10. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

11. Third Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the App (e.g., you must not be in violation of your wireless data service agreement when using the App).

12. Third Party Beneficiary

You and the Developer acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

13. Limitation of Liability

To the fullest extent permitted by law, Nana Pinyin Tutor shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.
